This weekend, while practicing baseball with my youngest son(10yr old), long story short, he hit "Dinger" dead center field over the fence shattering the windshield of a mini van. The question is, who is responsible for the damage. The car was parked in a parking spot at a city owned little league baseball field.
We see this in the insurance industry all of the time. Depending on the signs posted in the parking lot (IE park at your own risk type of thing) you are most likely responsible for your sons dinger. Technically it is covered under your homeowners liability policy however the surcharges for putting such a small claim($300-$500) would be greater then just paying for it outright.
I have seen it happen once exactly like your situtation (a policyholders son hit s foul ball) and multiple times with golfballs the went awry.

Doesn't sound right Josh, but I know you're correct. As a matter of fact I already wrote the check for the windshield. It still just doesn't sound right. Are there no rules for common scense in reguards to where you park your car? I know we sign liability waivers when we play paintball, but isn't that for the paintball parks liability. Am I responsible if I shoot and hurt someone on the paintball field? Is it not implied that when you park your car ten feet outside the fence in center field that it may get hit by a baseball.
